Terms of Service

1. Introduction

Welcome to Creatune.ai ("Creatune," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features of the Service, you must create an account using Google OAuth sign-in. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Description of Service

Creatune is an AI-powered music generation platform that allows users to create original songs from text descriptions, lyrics, or prompts. We provide tools including AI music generation, lyrics generation, song extension, and more. Creatune is an independent product and is not affiliated with, endorsed by, or operated by any third-party AI model provider.

5. Credits System

The Service operates on a credits-based system. Credits are required to use certain features such as music generation, lyrics generation, and song extension.

  • Subscription credits are allocated on a per-billing-cycle basis and do not roll over to the next cycle.
  • One-time credit pack purchases do not expire and remain in your account until used.
  • If a task fails due to a system error, the credits charged for that task will be restored to your account. This restoration is not a cash refund.
  • We reserve the right to modify credit costs for features at any time with reasonable notice.

6. Prohibited Conduct

You agree not to use the Service to:

  • Generate content that infringes on any third party's intellectual property rights.
  • Create hateful, harassing, defamatory, or discriminatory content targeting any individual or group.
  • Produce deepfake audio or content that impersonates real individuals without their consent.
  • Generate content that promotes violence, illegal activities, or harmful behavior.
  • Attempt to reverse-engineer, decompile, or exploit the Service or its underlying technology.
  • Use automated tools or bots to access the Service without our prior consent.
  • Register or enforce exclusive automated Content ID or fingerprint claims over substantially unmodified AI output when they may block another user's lawful use.

7. Payment & Subscription

All payments are processed securely through Stripe. By purchasing a subscription or credit pack, you agree to the following:

  • Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled before the renewal date.
  • Cancellation takes effect at the end of the current billing period. You will retain access to your subscription benefits until then.
  • Except where applicable law requires otherwise, completed initial subscription payments, renewals, and one-time credit pack purchases are non-refundable, whether or not the associated credits have been used.
  • Canceling a subscription prevents future renewals only and does not create a refund for a payment already completed. Failed tasks are compensated by restoring platform credits rather than returning cash.
  • Prices may change with reasonable notice. Existing subscribers will be notified before any price changes take effect on their next billing cycle.
  • All charges are in USD. You are responsible for any applicable taxes.

8. Intellectual Property

You represent and warrant that you own or have all rights, licenses, consents and releases needed for every prompt, lyric, recording, composition, voice, sample, image, name, likeness or other item you submit. Processing an upload does not clear or license that material for you.

As between you and Creatune, we do not claim ownership of eligible results created for your account. Your use remains subject to applicable law, third-party rights, model-specific terms and the Business License Agreement where commercial rights are required. AI output may not be unique, may resemble other material and may not qualify for copyright protection. The Creatune brand, logo and platform technology remain our property.

9. Playback, Downloads and Access

A successful payment permanently unlocks full-length playback for generated tracks that already exist at that time. Tracks generated while you have an active subscription or a remaining balance of purchased credits are also permanently unlocked. These playback rights continue in your library and on public share links after that paid access lapses. Tracks generated only with free, promotional, gifted or compensatory credits remain playable as a preview of approximately the first half until a later successful payment.

While you hold an active subscription or a remaining balance of purchased credits, you may download your generated tracks as MP3 files and keep those files indefinitely, including after your subscription or credits lapse. Creating a new lyric-video export likewise requires current paid access; completed exports remain available. Eligible tracks covered by an annual subscription payment or a new Creator, Studio, or Label one-time credit-pack payment can download a Business License certificate. Monthly subscriptions, legacy one-time credit packs, free, promotional, gifted and compensatory credits do not qualify unless expressly stated.

Audio you upload yourself remains your own file. It is playable in full and downloadable at any time, regardless of your subscription status.

Permanent full playback does not itself grant future generation, download, export or commercial-use benefits. Those features continue to follow the current plan and credit rules shown at purchase. This does not affect your rights in the content you generated, which are described in Section 8.

A certificate does not clear user uploads or third-party material and does not guarantee copyrightability, non-infringement, distributor acceptance or Content ID clearance. The Business License Agreement controls the scope, conditions and revocation of commercial rights. Normal cancellation or plan expiry does not end an eligible license, but a related refund, chargeback, fraud, material breach or rights violation does. A downloaded PDF does not preserve rights after revocation.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in prohibited conduct. Upon termination, your right to use the Service will immediately cease. Any unused credits or remaining subscription time may be forfeited upon termination for cause.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREATUNE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU WILL DEFEND, INDEMNIFY AND HOLD HARMLESS CREATUNE, ITS AFFILIATES AND THEIR PERSONNEL FROM CLAIMS, LOSSES, LIABILITIES, DAMAGES, PENALTIES, COSTS AND REASONABLE LEGAL FEES ARISING FROM YOUR INPUTS, YOUR USE OR DISTRIBUTION OF A RESULT, YOUR BREACH OF THESE TERMS OR THE BUSINESS LICENSE AGREEMENT, OR YOUR VIOLATION OF LAW OR THIRD-PARTY RIGHTS.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Creatune operates, without regard to its conflict of law provisions.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
